Santiago, Brazil –The Federal Court of Justice (FJ) upheld the decision of a Brazilian Supreme Court (STC) on the controversial anti-impotence drug Viagra (sildenafil).
The court ruled that the drug was not medically necessary to treat erectile dysfunction (ED) and that the company’s marketing efforts to promote its erectile dysfunction drug were “unjustified.”
The trial took place in Federal Court, located in the Federal District, in the capital, Federal City. The Federal Court of Justice granted the company a licence to manufacture the drug, which the company had claimed infringed on its intellectual property.
The trial was also a case of first impression in Brazil. On the day the Federal Court decision was published, a group of attorneys from the company were in a consultation with the trial judge, who told the public it was in the best interests of the company to continue its research and development efforts.
